Jacob TOOLEY 20 September 1833 / Probate: Feby. Term 1834
It is my will and desire that all my just debts be paid in as short a time as possible after my death and for that purpose I hereby enjoin my executors to sell and dispose of to some speculation in slaves who do not reside in this county, my Negro man Abraham, and the amount of the sale be appropriated to the payment of my debts and if there should be a surplus then it should go to the purchase of another Negro for the benefit of my wife and children.
And after my wife's death said Negroes to be divided among all my children who may be living at the time of her death. It is my will and desire that my wife, Polly TOOLEY, and all my children now living with me and them that are single and living abroad should have and enjoy the benefit of the residue of my property, both real and personal.
Therefore I lend unto my wife the use of my plantation, all my Negroes, stock of every description, and house and kitchen furniture to be used in common for all their benefit. After my wife's death it is my will and desire that my son Sheldon TOOLEY should own all lands and plantation whereon I now live. All property whatever named, excepting the land given to Sheldon, shall be equally divided among my children who may be living at the time of my
wife's death.
